Welcome to the website of Hawaiian Council, a Hawaii-based nonprofit organization (“we,” “our,” or “us”). By accessing or using our website (“Site”), you agree to the following Terms of Use. Please read them carefully.
1. Acceptance of Terms
By accessing or using this Site, you agree to be bound by these Terms of Use and all applicable laws and regulations of the State of Hawaii and the United States. If you do not agree, please do not use the Site. We may update these Terms of Use at any time. Your continued use of the Site following the posting of changes to these Terms of Use will indicate your acceptance of those changes.
2. Informational Purposes
This Site is intended to provide information about our nonprofit mission, programs, and opportunities to support our work. Without limiting anything else in these Terms or otherwise, Hawaiian Council is not responsible for any errors or omissions in the Site or Site Materials, as defined in Section 3 of these Terms and Conditions.
3. Intellectual Property
Hawaiian Council owns or licenses all data, content, graphics, forms, artwork, images, photographs, functional components and any software concepts and documentation and other material on, in or made available through the Site (“Site Materials”), as well as the selection, coordination, arrangement, and organization and enhancement of the Site Materials. All Site Materials are protected pursuant to copyright, trademark, patent and other applicable laws. You may use this Site for limited noncommercial, educational, and personal use only, or for “fair use” as authorized in the United States copyright laws, and provided further that you also retain all copyright and other proprietary notices contained on the materials and cite the author and source of the materials.
You agree not to remove or alter any copyright notice or any other proprietary notice on any Site Materials. As between any user and Hawaiian Council, all names, trademarks, service marks, certification marks, symbols, slogans or logos appearing on the Site are proprietary to Hawaiian Council or its affiliates, licensors, or suppliers. Under no circumstances will you have any rights of any kind in or to the Site Materials, other than the right to use the Site Materials in accordance with these Terms.
4. Unauthorized Activities
You agree that you will not use the Site for (a) any illegal or unauthorized purposes that violate any local, national, or international laws (including but not limited to import, export, copyright, and trademark laws); (b) modifying, copying, distributing, displaying, performing, reproducing, publishing, licensing, creating derivative works from, transferring, selling any of the Site Materials, unless otherwise authorized by these Terms or in a separate written agreement with Hawaiian Council; (c) attempting to gain unauthorized access to Hawaiian Council’s computer system or engaging in any activity that interferes with the performance of, or impairs the functionality of the Site or any services provided through the Site; or (d) removing, circumventing, disabling, damaging or otherwise interfering in any way with any security-related features of the Site aimed at preventing or restricting the unauthorized use of the Site or any of the Site Materials.
5. Donations and Payments
All donations made through the Site are voluntary and non-refundable unless otherwise stated. We use secure third-party payment processors; however, we are not responsible for errors or issues caused by those services.
Please ensure your donation information is accurate. You agree not to use fraudulent payment methods.
6. User Submissions
From time to time, you may have an opportunity to post comments, feedback, information, content, text, files, graphics, postings, and other materials and information for access, use, viewing and commentary by other users to the Site (“User Content”). You agree that you will comply with all requirements and procedures for posting on this Site. Hawaiian Council does not endorse any opinions or recommendations posted or transmitted by you or others.
By posting User Content, you represent that you have the full legal right to provide the User Content and that use of the User Content by the Site and all other persons and entities will not (a) infringe any intellectual property rights of any person or entity or any rights of publicity, personality, or privacy of any person or entity; (b) violate any law, statute, ordinance, regulation, or agreement; or (c) constitute disclosure of any confidential information owned by any third party. Upon your submission of User Content, you grant Hawaiian Council a worldwide, perpetual, irrevocable, transferable license to access, use, distribute, reproduce, display, modify, create derivative works based upon, and sublicense the User Content, all without any compensation to you whatsoever.

8. Disclaimer of Warranties

HAWAIIAN COUNCIL, ITS AFFILIATES, DIRECTORS, OFFICERS AND EMPLOYEES, AND OTHER AGENTS AND REPRESENTATIVES SHALL HAVE NO LIABILITY FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, CONSEQUENTIAL, COMPENSATORY, SPECIAL, PUNITIVE, OR INCIDENTAL DAMAGES ARISING OUT OF OR RELATING TO THE USE OF THIS WEBSITE.
10. Indemnification
You shall indemnify Hawaiian Council and its directors, officers, employees, agents, contractors and licensors against all claims, actions, suits, and other proceedings arising out of or incurred in connection with the Site and your use of the Site, the Site Materials or any services, product or data obtained through the Site.

12. Internet Security
Hawaiian Council uses reasonable efforts to ensure that the Site is generally available. However, there will be occasions when access to the Site will be interrupted or unavailable. Hawaiian Council will use reasonable efforts to minimize such disruption where it is within its reasonable control.
